SOCIAL MEDIA AND ONLINE POLICY

GENERAL:

Regardless of compliance with the Policies and Procedures set forth herein, all Ncrease Independent Social Business Owners are personally responsible for their online postings and all other online activity that relates to Ncrease.

Therefore, even if an Ncrease Independent Social Business Owner does not own or operate a blog or social media site, if an Ncrease Independent Social Business Owner posts to any such site that relates to Ncrease or which can be traced to Ncrease, the Ncrease Independent Social Business Owner is responsible for the posting and must act in a way that builds, strengthens and enhances Ncrease’s reputation, image and standing in the community.

Ncrease Independent Social Business Owners are also responsible for postings which occur on any external website that the Ncrease Independent Social Business Owner owns, operates or controls. Ncrease Independent Social Business Owners must disclose their full names on all relevant social media profiles that relate to Ncrease and its products or business, and each must conspicuously identify himself or herself as a “Ncrease Independent Social Business Owner.” Anonymous postings or use of an alias is prohibited.

Ncrease Independent Social Business Owners must avoid inappropriate conversations, comments, images, video, audio, applications or any other adult, profane, discriminatory or vulgar content. Determination of what is inappropriate is at Ncrease’s sole discretion, and offending Ncrease Independent Social Business Owners will be subject to disciplinary action.

Ncrease Independent Social Business Owners may not use blog spam, spam-texting or any other mass-replicated methods to leave comments on any website, blog or message board. Comments that Independent Social Business Owners create or leave online must be useful, unique, relevant and specific to the blog’s article.

Ncrease Independent Social Business Owners may not use any geographic references in the page names/ titles or URLs of their Ncrease-related social media or external websites. For purposes of clarification and the avoidance of doubt, other than for a Default URL or an approved amendment to a Default URL, Ncrease Independent Social Business Owners may not use the terms “Ncrease,”  or any derivation thereof, in any external website address or related URL e.g., www.buyNcrease.com, or www.blogspot.Ncreasecanada.com.

Any External Website which contains “Ncrease” or other Ncrease product and program names, or any derivation thereof in the URL, must be transferred to Ncrease or closed/terminated upon demand by Ncrease. In no event may the Ncrease Independent Social Business Owner sell such domain name to any third party without the prior express written consent of Ncrease.

 
   

INDEPENDENT SOCIAL BUSINESS OWNER WEBSITES:

If an Independent Social Business Owner desires to utilize an Internet web page to promote his or her Independent Business, he or she may do so only through the Company’s replicated website program, using the official Ncrease template. This program permits Independent Social Business Owners to advertise on the Internet and to use a home page design that can be personalized with the Independent Social Business Owner’s contact information. These websites give the Independent Social Business Owner a professional and Company-approved presence on the Internet. Online sales may only be generated from an Independent Social Business Owner’s Ncrease replicated website.

An Independent Social Business Owner shall not use “blind” ads on the Internet that make product or income claims which are ultimately associated with Ncrease products or services, the Ncrease opportunity or the Ncrease Rewards Plan.

SOCIAL MEDIA & OTHER INTERNET USE:

Independent Social Business Owners may use the Internet, social networking sites, blogs, social media and applications, and other sites that have content that is based on user participation and user-generated content, forums, wilds and podcasts to do the following:

  • Communicate preliminary information about Ncrease or their involvement with Ncrease;
  • Direct users to their Ncrease or replicated website; and Post Ncrease-produced business

Support materials from Ncrease corporate sources which can be downloaded from Ncrease’s virtual office — Such use is permitted if it:

  • Is incidental to the primary use of the website or forum,
  • Does not contain any false or misleading information about Ncrease, its products or business opportunities, and
  • Conforms to the other policies set forth herein, including, without limitation, the policies related to the use of Ncrease’s trademarks, trade names and other intellectual

 

 

 

THE OFFICIAL NCREASE PUBLIC FACEBOOK (OR SIMILAR) PAGES:

Ncrease has an official public Facebook page which it uses to invite potential customers and Independent Social Business Owners to investigate the Company. It is not intended to be used by Ncrease Independent Social Business Owners to sell product or promote their business or to interact with other Independent Social Business Owners or consumers.

As such, Ncrease Independent Social Business Owners may not place linking information on the public Ncrease Facebook page, nor may they post any pricing, promotions, marketing material, sales, advertisements, or announcements relating to their businesses.

Ncrease reserves the right to remove any messages posted on the official Company Facebook page as determined in its sole discretion.

 

Independent Social Business Owners may also create a closed group and may utilize such group to educate, discuss and disseminate information about Ncrease, its products, science and business opportunity amongst themselves and their teams.

 

 

USE OF THIRD-PARTY INTELLECUTAL PROPERTY:

If Ncrease Independent Social Business Owners use the trademarks, trade names, service marks, copyrights or intellectual property of any third party in any online posting, it is their responsibility to ensure that they have received the proper license to use such intellectual property and pay the appropriate license fee. All third-party intellectual Ncrease property must be properly referenced, and the user must adhere to any restrictions and conditions that the owner of the intellectual property places on the use of its property.

 

RESPECTING PRIVACY:

Ncrease Independent Social Business Owners must always respect the privacy of others in their postings. They must not engage in gossip or advance rumors about any individual, company or competitive products or services. Ncrease Independent Social Business Owners may not list the names of other individuals or entities on their postings unless they have the written permission of the individual or entity that is the subject of their posting. This includes LIVE broadcasts and using the LIVE Facebook feature.

 
   

PROFESSIONALISM:

Ncrease Independent Social Business Owners must ensure that their postings are truthful and accurate. This requires that they fact-check all material they post online. They should also carefully check their postings for spelling, punctuation and grammatical errors. Use of offensive language is prohibited.

PROHIBITED POSTINGS:

 

Ncrease Independent Social Business Owners may not make any postings or link to any postings or other material that:

  • Is sexually explicit, obscene or pornographic;
  • Is offensive, profane, hateful, threatening, harmful, defamatory, libelous, harassing, or discriminatory {whether based on race, ethnicity, creed, religion, gender, sexual orientation, physical disability, or otherwise);
  • Is graphically violent, including any violent video game images;
  • Is solicitous of any unlawful behavior;
  • Engages in personal attacks on any individual, group or entity; or
  • Is in violation of any intellectual property rights of the Company or any third

 

 

 

RESPONDING TO NEGATIVE ONLINE POSTS:

Ncrease Independent Social Business Owners should not converse with one who places a negative post against them, or other Ncrease Independent Social Business Owners or Ncrease. They should report negative posts to the Company at compliance@ncrease.com. Responding to such negative posts simply fuels a discussion with persons carrying a grudge that does not hold themselves to the same high standards as Ncrease, and therefore damages the reputation and goodwill of Ncrease.

 

CANCELATION OF YOU NCREASE BUSINESS:

 

If an Ncrease Independent Social Business Owner’s Ncrease business is cancelled for any reason, he or she must discontinue using the Ncrease name, and all of Ncrease’s trademarks, trade names, service marks and other intellectual property, and all derivatives of such marks and intellectual property, in any postings and all external websites that he or she utilize. If a Ncrease Independent Social Business Owner’s post on any social media site on which they have previously identified themselves as a Ncrease Independent Social Business Owner, they must conspicuously disclose that they are no longer an Independent Ncrease Independent Social Business Owner.

 

E-MAIL:

Independent Social Business Owners must use the following disclaimers within any email correspondence when discussing Ncrease or the Ncrease opportunity or program:

The sender of this email is an Independent Social Business Owner of Ncrease and as such is an independent contractor of Ncrease. Independent Social Business Owners are not employees of Ncrease. This email message (including attachments) contains information which may be confidential and/or legally privileged. Unless you are the intended recipient, you may not use, copy or disclose to anyone the message or any information contained in the message or from any attachments that were sent with this email. If you have received this email message in error, please advise the sender by email, and delete the message. Unauthorized disclosure and/or use of information contained in this email may result in civil and criminal liability.

 

ONLINE CLASSIFIEDS:

 

Current and former Independent Social Business Owners may not use online classifieds (including, but not limited to, Craigslist) to list, sell or retail specific Ncrease products, product bundles or the opportunity.

 

ONLINE AUCTIONS:

Ncrease’s products and services may not be listed on eBay or other online auctions, nor may Independent Social Business Owners enlist or knowingly allow or facilitate a third party to sell Ncrease products on eBay or other online auctions.

 

ONLINE RETAILING:

 

Independent Social Business Owners may not list or sell Ncrease products or services in any retail store or ecommerce site, including Amazon.com or the like (with the exception of their own Replicated Website). Additionally, Independent Social Business Owners may not:

  • Enlist or knowingly allow a third party to sell Ncrease products on any online retail store or ecommerce site

 

  • Sell products to a third party that the Independent Social Business Owner has reason to believe will sell such products on any online retail store or ecommerce site.

 

  • Independent Social Business Owners may obtain product images and descriptions from their BackOffice, which Independent Social Business Owners may display only on their Ncrease replicated Website.

 

 

 

BANNER ADVERTISMENT:

 

Independent Social Business Owners may place banner advertisements on their third-party websites (as described herein below); provided, however, that they only use Ncrease-approved templates and images from the BackOffice, and do not list any pricing, discounts or promotions of any Ncrease product on such advertisement. Any Ncrease­ related banner advertisements on these websites must link back directly to their Replicated Ncrease Websites.

 

SPAM LINKING:

Spam linking is defined as multiple consecutive submissions of the same or similar content into blogs, wikis, guest books, websites or other publicly accessible online discussion boards or forums and is not allowed. This includes blog spamming, blog comment spamming and/or spam-texting. Any comments an Independent Social Business Owner makes on blogs, forums, guest book, etc., must be unique, informative and relevant.

 

DIGITAL MEDIA SUBMISSION (E.G., YOUTUBE, iTUNES, INSTAGRAM, FACEBOOK, PHOTO BUCKET, ETC):

Independent Social Business Owners may not upload, submit or publish Ncrease-related video, audio or photo content to any website without the expressed permission from Ncrease.

 

SPONSORED LINKS, PAY-PER-CLICK /PPC ADS, AND PAID SEARCH:

 

Sponsored links or pay-per-click ads (PPC) are acceptable as described herein. The destination and display URL must be the same. The destination of the PPC must be the external website, not the Independent Social Business Owner’s Ncrease replicated Website, and must not portray any URL that could lead the user to believe they are being directed to a Ncrease corporate website or be inappropriate or misleading in any way. Independent Social Business Owners cannot use Ncrease’s trade names, trademarks or other copyrights when submitting Google AdWords, MSN Bing, Key Words, etc. to Internet search engines.

 

SPAMMING AND UNSOLICITED FAXES:

 

Except as provided in these Policies and Procedures, Independent Social Business Owners may not send or transmit unsolicited faxes, mass e-mail distribution, unsolicited e-mail or “spamming” relative to the operation of their Ncrease Independent Social Business. The terms “unsolicited faxes” and “unsolicited e-mail” mean the transmission via tele-phone, facsimile or electronic mail, respectively, of any material or information advertising or promoting Ncrease, its products, its Rewards Plan or any other aspect of the company which is transmitted to any person, except that these terms do not include a fax or email:

  • to any recipient with that recipient’s prior express invitation or permission; or
  • to any person with whom the Independent Social Business Owner has an established business or personal relationship. The term “established business or personal relationship” means prior or existing relationship formed by a voluntary two-way communication between an Independent Social Business Owner and a person, based on:
  • an inquiry, application, purchase or transaction by the person regarding products offered by such Independent Social Business Owner; or
  • a personal or familial relationship, which relationship has not been previously terminated by either

 

TELEMARKETING:

 

The Federal Trade Commission and the Federal Communications Commission, as well as other applicable local authorities, each have regulations that restrict telemarketing practices. Many authorities have “do not call” regulations as part of their telemarketing laws. Although Ncrease does not consider Independent Social Business Owners to be “telemarketers” in the traditional sense of the word, these government regulations broadly define the term “telemarketer” and “telemarketing” so that an Independent Social Business Owner’s inadvertent action of calling someone whose telephone number is listed on a “do not call” registry could cause them to violate the law. Moreover, these regulations must not be taken lightly, as they can carry significant penalties and fines, per violation. Therefore, Independent Social Business Owners must not engage in telemarketing in the operation of their Ncrease Independent Social Business. The term “telemarketing” means the placing of one or more telephone calls to an individual or entity to induce the purchase of a Ncrease product or service, or to recruit them for the Ncrease opportunity. “Cold calls” made to prospective customers or Independent Social Business Owners that promote either Ncrease’s products or services or the Ncrease opportunity constitute telemarketing and are prohibited. In addition, Independent Social Business Owners shall not use automatic telephone dialing systems or random phone lists relative to the operation of their Ncrease Independent Social Business. The term “automatic telephone dialing system” means equipment which as the capacity to:

  • Store or produce telephone numbers to be called using a random or sequential number generator; and

 

  • To dial such numbers. In addition, Independent Social Business Owners acknowledge and agree to abide by telemarketing

 

Advertised Product Price

Independent Social Business Owners may not advertise Ncrease products at a price LESS than the suggested retail price of one

(1) unit of the Ncrease product. Independent Social Business Owners also agree that all advertising regarding the price of Products and Services will be truthful and will not contain misleading statements (e.g. “lowest price available” which infers that an Independent Social Business Owner is able to sell the Products at a lower price than other Independent Social Business Owners, etc.). Any violation of this by an Independent Social Business Owner shall constitute a breach of the Agreement and may result in punitive action.
